Harris levels two main criticisms against our original defence of QALYs (Quality Adjusted Life Years). First, he rejects the assumption implicit in the QALY approach that not all lives are of equal value. Second, he rejects our appeal to Rawls's veil of ignorance test in support of the QALY method. In the present article we defend QALYs against Harris's criticisms. We argue that some of the conclusions Harris draws from our view that resources should be allocated on the basis of (...) potential improvements in quality of life and quantity of life are erroneous, and that others lack the moral implications Harris claims for them. On the other hand, we defend our claim that a rational egoist, behind a veil of ignorance, could consistently choose to allocate life-saving resources in accordance with the QALY method, despite Harris's claim that a rational egoist would allocate randomly if there is no better than a 50% chance of being the recipient. Harris argues that if QALYs are used only 50% of the population will be eligible for survival, whereas if random methods of allocation are used 100% will be eligible. We argue that this involves an equivocation in the use of "eligible", and provides no support for the random method. There is no advantage in having a 100% chance of being "eligible" for survival behind a veil of ignorance if you still only have a 50% chance of survival once the veil (...) is lifted. A 100% chance of a 50% chance is still only a 50% chance. We also argue that Harris provides no plausible way of dealing with the criticism that his random method of allocation may result in the squandering of resources. (shrink)

Substantial in every way, it is physically imposing, magnificently printed on heavy, glossy stock and profusely illustrated with splendid color reproductions of all the master’s major works and many sketches and preparatory drawings, as well as etchings and dry-point engravings. (...) Gary Schwartz, who studied art history at New York University and Johns Hopkins University, is now living in the Netherlands. The merits of his book are enormous. Not only is it filled with magnificent reproductions, there are tables and graphs detailing such things as the number of Rembrandt paintings in catalogues from 1836 to 1992; analyses of the artist’s borrowings and adaptations in five-year periods; key dates in the life of the man; Rembrandt’s relation to the forms of sale for paintings in the Dutch seventeenth century; and so on. There is even a computer rendering of the famous depiction of Captain Banning Cocq’s Company of Guards at the Gates of Amsterdam (popularly called The Night Watch), specifying the weapons shown and identifying all present, either by name and title or by a description, such as “girl in gold and blue,” “pikeman,” “musketeer,” etc.A sampling of the chapter headings and subcategories suggests just how comprehensive is Schwartz’s treatment: 1. Introduction, 2. A Dutch Artist’s Life, 3. Family, Loved Ones, Households, 4. Craft, 5. Earning and Spending, 6. Patrons, 7. Landscape, 8. Humankind, 9. Man and God. Just the specifics of the last chapter are remarkably capacious: Holy Family; Christ’s Ministry; Passion, Death and Afterlife; Divine Intervention; Holy People; Moral Examples from the Old Testament; The Man of God, Simeon; Afterlife; and Rembrandt as a Christian Rhetorician of the Brush. It’s hard to imagine a better reference for the lay reader than The Rembrandt Book.The book is also full of interesting contrasts of opinion as well as some surprising remarks. As for one of the latter, Schwartz writes that Rembrandt’s “portraits are said to be more ‘psychological’ than those of his contemporaries. What this might mean I frankly do not understand” (213). He goes on to note that the field of psychology did not exist in Rembrandt’s time. However, from long before its invention people spoke of Rembrandt’s ability to reveal the soul of the sitter. Indeed, the reason I was not surprised, although somewhat distressed, when the Rembrandt Research Project—a group of connoisseurs set up in 1969 with the explicit charge of authenticating all works ascribed to the master—announced in 1985 that The Man with a Golden Helmet in Berlin was not by the master at all, was that I had all along been troubled by this face that lacked the quality of animation in repose so [End Page 115] characteristic of Rembrandt portraits. Schwartz thinks the artist would have to have relied upon the ancient theory of the humors to do “characterological descriptions” of his sitters, and that in portraiture, “such characterizations would quickly resemble caricatures.” And, indeed, they do, but in profoundly subtle ways, much as someone like the popular illustrator Norman Rockwell employed tiny caricature-like distortions to project a kind of homely Americanism. I’m not comparing Rockwell to Rembrandt but choosing a realistic illustrator in whose work the trick is more apparent. Caricature can be as broad as it is in Jacques Callot, William Hogarth, or Honoré Daumier and yet be a feature of true art. Or so it seems to me, admittedly, a sometimes cartoonist as well as painter and engraver.Schwartz’s completeness of coverage leads him to include, in addition to superb drawings and prints, some that are so careless and hasty as to make one doubt their authenticity. One of the works of marginal quality is an etching of Six’s Bridge, which is said to have been created outdoors, hastily, on the site. This is a hotly debated issue. Rembrandt is known to have carried “varnished”—that is, grounded—copper etching plates, so there wouldn’t seem much reason to... (shrink)

This paper discusses the attempt in this issue of the journal by Peter Singer, John McKie, Helga Kuhse and Jeff Richardson, to defend QALYs against the argument from double jeopardy which I first outlined in 1987. In showing how the QALY and other similar measures which combine life expectancy and quality of life and use these to justify particular allocations of health care resource, remain vulnerable to the charge of double jeopardy I am able to clarify some of the (...) central issues concerning the value of life. In particular, the idea that the value of a life varies with its life expectancy and with its quality, understood in terms of its richness, variety, success etc, is subjected to special examination. It is shown how defenders of QALYs are committed to the view that so far from all lives being of equal value, all lives are necessarily of subtly different value. The paper then analyses the use to which the notorious 'veil of ignorance' has been put both by Singer et al and by others and shows how this device of John Rawls's cannot do the work so often assigned to it. The paper then considers the issue of hypothetical consent and the role that it can play in justifying disposing of the lives of people who have not in fact consented to their lives being disposed of in particular ways. Finally, the paper makes some points about the comprehensive nature of the data collection and storage which would be required by QALY advocates and points out the independent problems attaching to licensing such comprehensive collection and use of personal data. This book demonstrates how children's imagination makes a continuing contribution to their cognitive and emotional development.

Critics of social injustice argue that the agent of transformative social change will (or should) be a mass agent; namely, an agent that is large, complex, and geographically dispersed. Traditional theories of collective agency emphasize the presence of shared intentions and common knowledge, but mass agents are too large for such cohesion. To make sense of mass agency, I suggest a new approach. On the solidarity theory of mass agency, a mass agent is composed of (a) organizers who intend to (...) fight for social change and (b) supporters who are in solidarity with organizers. (shrink)

Wolfson's systematic presentation of the philosophy of Spinoza has long been a classic. It is with pride that we make it available again in a one-volume edition.

An analysis of two heuristic strategies for the development of mechanistic models, illustrated with historical examples from the life sciences. In Discovering Complexity, William Bechtel and Robert Richardson examine two heuristics that guided the development of mechanistic models in the life sciences: decomposition and localization. Drawing on historical cases from disciplines including cell biology, cognitive neuroscience, and genetics, they identify a number of "choice points" that life scientists confront in developing mechanistic explanations and show how different choices result in (...) divergent explanatory models. Describing decomposition as the attempt to differentiate functional and structural components of a system and localization as the assignment of responsibility for specific functions to specific structures, Bechtel and Richardson examine the usefulness of these heuristics as well as their fallibility—the sometimes false assumption underlying them that nature is significantly decomposable and hierarchically organized. When Discovering Complexity was originally published in 1993, few philosophers of science perceived the centrality of seeking mechanisms to explain phenomena in biology, relying instead on the model of nomological explanation advanced by the logical positivists (a model Bechtel and Richardson found to be utterly inapplicable to the examples from the life sciences in their study). Since then, mechanism and mechanistic explanation have become widely discussed. In a substantive new introduction to this MIT Press edition of their book, Bechtel and Richardson examine both philosophical and scientific developments in research on mechanistic models since 1993. This paper shows that moral progress is a substantive and plausible idea. Moral progress in belief involves deepening our grasp of existing moral concepts, while moral progress in practices involves realizing deepened moral understandings in behavior or social institutions. Moral insights could not be assimilated or widely disseminated if they involved devising and applying totally new moral concepts. Thus, it is argued, moral failures of past societies cannot be explained by appeal to ignorance of new moral ideas, but must be (...) understood as resulting from refusals to subject social practices to critical scrutiny. Moral philosophy is not the main vehicle for disseminating morally progressive insights, though it has an important role in processes that lead to moral progress. Yet we have grounds for cautious optimism, since progressive moral insights can be disseminated and can, sometimes, have constructive social effects. (shrink)

While most discussions of political realism in the West draw their inspiration from thinkers such as Thucydides, Machiavelli, and Hobbes, they were far from the only political theorists developing such an approach. Rather, we see realist approaches to politics not only in a vast array of European thinkers throughout history, but also in in a diverse range of non-European traditions. From Kautilya’s 2nd c. BCE Sanskrit classic to the eponymously named Han Feizi from China, a variety of realist visions were (...) developed alongside arguments detailing structural problems in the more idealist political visions of their rivals. One such thinker, whose ideas have largely been lost to the contemporary world was the Chinese philosopher Shen Dao (c. 350-275 BCE). -/- One of the most philosophical intriguing arguments Shen Dao develops focuses on the sources of political resentment and the necessity of eliminating them as a prerequisite to a strong and stable society and state. This essay develops Shen Dao’s argument that resentment arises not merely when people’s desires are not fulfilled but rather when there was an expectation that they could have been fulfilled and work to demonstrate how he envisions eliminating sources of resentment in the political sphere. In doing so, it engages with much more prevalent Confucian views, demonstrating that Shen Dao presents a trenchant criticism of one of the very bases of Confucian political philosophy and, indeed any political theory that develops itself from moral foundations. -/- This paper closes with an analysis of how Shen Dao’s ideas may be brought into conversation with those of political realists more familiar to a Western audience, with a goal of “pursuing the ideal of working with similarities in differences and differences in similarities.” In particular it raises the question for students of why the worries of resentment were not foregrounded in the West in the way that they were by Chinese realists. This provides students with entry into examining the ways in which different cultures approach very similar topics and allows us to more deeply reflect not only on why certain things were emphasized in a particular tradition but why others were de-emphasized or seemingly ignored. One of the central pillars of Vygotsky’s contribution to social science is his concept of mediation: the process through which the social and the individual mutually shape each other. His rich, complex and challenging texts focus on a nuanced notion of mediation that was not necessarily visible to those active in the command-and-control climate of the Stalinist era. The article focuses on this notion of the lack of visibility in mediation.

In his monumental Philosophy of the Kalam the late Harry Wolfson--truly the most accomplished historian of philosophy in our century--examined the early medieval system of Islamic philosophy. He studies its repercussions in Jewish thought in this companion book--an indispensable work for all students of Jewish and Islamic traditions. Wolfson believed that ideas are contagious, but that for beliefs to catch on from one tradition to another the recipients must be predisposed, susceptible. Thus he is concerned here not so much (...) with the influence of Islamic ideas as with Jewish elaboration, adaptation, qualification, and criticism of them. To this end he examines passages reflecting Kalam views by a wide variety of Jewish thinkers, including Isaac Israeli, Judah Halevi, Abraham ibn Ezra, and Maimonides. As always in Wolfson's work, two aspects are apparent: the special dimensions of Jewish thought as well as its relation to other traditions. And as always his prose is both graceful and precise. They share a belief that all too often older people are not treated justly or fairly, and also a belief that this is particularly true with regard to a proper respect for their dignity as people and a proper allocation of medical and social resources. Their papers, in various ways, give evidence as to what is happening and arguments, based on philosophical ethics, as to why it is wrong. (...) The authors also have a range of proposals, backed by argument and evidence, and drawing on factual material as well as philosophical argument, as to what could be done to improve the situation. This is a book for anyone, whether themselves elderly, looking after an older person, professionally involved in working with older people, or simply realising that one day they will be old, who wants to learn about what is wrong with the present situation and how it might be made better. Thought experiments and normative case studies can play different and complementary roles in moral and political philosophizing. Thought experiments help us to sculpt and refine normative concepts and alert us to contradictions between intuitive judgments and basic principles, or among intuitive judgments, thus informing our reflective equilibrium about what fundamentally matters. Normative case studies assist us in judging how to trade off conflicting values in specified circumstances. Engaging with a sufficient number of well-wrought normative case studies can thus inform our (...) ultimate judgments about the relative weights of different values. (shrink)

The character of Tom has the proportions of a mythic figure. His story has little of the melodrama of the secondary plot for his heroism in meeting the trials of slavery is manifested not in outward risks and adventures but in inner strength. In Simon Legree, Tom's final adversary, Stowe provides a perfect antithesis, an ultimate image of what slavery must do to the master who takes advantage of his position and uses his power without restraint; for Legree is an (...) ambitious Vermonter, not a Southern, an owner, not an overseer, and a product of the raw, final phase of slavery in the cotton plantations of the deep South. Legree bends every effort to brutalize Tom as though of necessity to prove that he and the South are right about Negroes and slavery, and Tom remains firm in his humanity and so disproves the sordid myth of his oppressor. It is Legree who is dehumanized by the institution of slavery. Tom emerges from the struggle as an example not simply of a black Christian slave, but of a heroic man in the face of intimidating and humiliating power. Moody E.
